History

Established in 1997.

Action Property Management began the management and leasing of homes on January 1, 1997. However, Terry Kozell, Designated Broker, began the business in 1985 by working with other real estate sales companies including West USA Realty. Over the past 25 years, thousands of owners and tenants have worked with Mr. Kozell and his staff in providing services so prooperty owners could enjoy a maximum amount of cash flow while maintaining their real estate investments.

Over the past 35 years, Terry Kozell has been a licensed Realtor, real estate Designated Broker, financial planner, insurance agent, and securties broker. After receiving a Masters Degree from the Unversity of Arizona and a Bachelors Degree from Arizona State University, Mr. Kozell worked in the securities and insurance business until 1985. After purchasing his own investment properties, he received his real estate license in 1985 to specialize in the investment, leasing, and management of real estate investment properties. Mr. Kozell has received a Residental Management Professional (RMP) desiganation from the National Association of Property Managers and he is a member of the National Association of Realtors, Arizona Association of Realtors, and the Southeast Regional Board of Realtors.

They are the worst property management company we’ve ever dealt with. They rented a condo my family owned then the tenant had a fire from cooking meth in a closet and they canceled the contract but made us pay them for the rest of the term because there was nothing for them to manage. Then they claimed to run a background check but wouldn’t show us that it was even done and wanted us to take their word for it. Only after the fact did we learn that he had a criminal past. Then when we tried to talk to Terry the broker we could never speak with him. DO NOT do any business with them you will be sorry if you do!

I am yet ANOTHER unhappy renter who, unfortunately, conducted business with this company. We moved out, end of the month, in May and we’re waiting on our security deposit checks to be mailed to the forwarding addresses they requested. After waiting over 2 weeks, my roommate and I both tried to get ahold of Abby with no success. After leaving numerous voicemails and emails, I walked into their office 6÷24÷15 and was told that we would not be receiving a check and, in fact, we owed them $ 52.99. Of course, there was no explanation as to why we were not going to see any of our $ 1200 deposit. They tried to charge us for the cost of remodeling a textured wall, a broken window (broken prior to move in), and a $ 350 cleaning fee because the house as not cleaned to their standards. We have pictures of the condo, that was filthy upon move in, that clearly depict the «standards» of their rentals.
After filing a claim with a renters protection agency, I received a call that the pictures were reviewed, by the broker, and we would be getting a check. The checks were supposedly sent out, certified mail, on 6÷29÷15 and we are still waiting. We have been unable to contact anyone at that office to provide us with information and will be seeking legal action.
I’m afraid our story is not the only one of this sort!

Do not rent from Action Property Management.
In the 5 years i’ve rented from APM, the only thing that’s gone without a problem is their collection of rent. If you do decide to rent, be very very very meticulous in noting problems with the property prior to moving in. This cannot be overstated. Be prepared to never speak to Terry and infrequently getting through to his staff over the phone. Also make sure to have a decent lawyer because the Owner, Terry Kozell, depends on his tenants having no legal representation. Below are some of the bigger issues encountered in the last 5 years.
1. Our AC unit was not functioning properly during the summer which caused it to run the entire day, while the temperature inside the house never got below 80 degrees. This caused astronomical electricity bills. APM sent several AC techs out to «repair» the unit after the 1st tech informed them that the unit needed replacing. This went on for 3 AZ SUMMERS! The unit was finally replaced after my lawyer sent a letter asking for replacement or breaking the lease without being charged.
2. During the initial showing, the home was being painted. There was white paint all over the carpet which the showing agent stated would be replaced prior to us moving in. It wasn’t. A week later the carpet was still covered in paint and APM charged us rent while we waited for it to be replaced.
3. We signed a 1 year lease extension every December allowing a $ 51 discount in rent. After 5 years of doing this, for some reason APM declined to accept the 2015 extension. The $ 51 discount was no longer applied. The only problem is we weren’t informed until July 2015. For 7 months our account accrued this balance. I was never able to speak with Terry, however his staff informed me that he «is not legally obligated to accept any lease extensions OR notify any tenants of an extension being declined.»

I went in to Action Property Management to speak with Terry about the services he provides to investment property owners and renters. He has been in business in the east Valley for nearly 20 years and really understands the property management landscape in the area. He was very straightforward with me in regards to the services he offers and was extremely knowledgeable about managing a wide-​breadth of properties types. In addition to him being very adept at his line of work, throughout our interaction I found Terry genuine and very easy to talk with regarding the housing and rental market in the Valley. I left feeling very comfortable with Action Property Management and I would highly recommend them to anyone who wants a seasoned professional to manage their property or to anyone who wishes to rent from a relationship-​focused company.

We own a property that we had Action Property manage for way too long, but they make the contract impossible to get out of without paying a huge fee. The renters contract and APM’s contract don’t have the same date so if you try to fire the rental company and the renter still has time left on their lease you have to pay APM fees for however many months they have left and vice versa. It’s pretty much set up so no matter what, you end up owning them a good chunk of change.
They also keep a reserve fund for repairs that they kept increasing to thousands of dollars. Okay, fine, it’s good to be prepared, but once we cancelled our contract with APM it took more than a month to get it refunded to us. We were joking that the owner probably had in some account gaining interest on our money.
Their quotes on repairs were unusually high and there are rumors around the rental/​real estate community that APM gets money kicked back to them from the contractors they hire.
3 out of the 5 renters they found ended badly, either destroying our home upon moving out or by breaking their lease.
I hope is someday karma kicks this company’s butt.

After seeing the complaints on Unilocal and BBB, not to mention, my own experience as an owner, I completely regret doing business with Terry Kozell and Action. Their lack of communication (unless they need more money), professionalism, and business model makes me question their motive. It was almost impossible to get a hold of Terry. He was unresponsive to requests even as simple as to return a call. Monthly statements listed vague description of fees/​charges. When he was questioned about the fees, his usual response was it was within his right to approve charges within the threshold limits as stated in the contract. Make you think who owns the service companies he uses. Tenant were placed for 3 months and then had to be evicted. The eviction fees were costly, questionable, and paid to Action in the form of various «admin» fees. In the event of an eviction, they made more money than they would keeping the tenant for the term of the lease. I’m sure they were thorough when they so-​called «screen» the tenant. We decided to part ways with Action and Terry only to find out that it was going to cost thousands more to do so. I would be very wary in doing any business with these people. Be careful and do your own research. Personally, I would never ever recommend «inaction property management» and this turkey to anyone.

When will Unilocal allow 0 stars? I see the reviews from renters, this review is from the home owner side: same thing. The number of complaints with BBB for this company speaks volumes (as of this review, 16 complaints in 3 years including mine). Poor service, excessive fees especially during an eviction, lack of responsiveness, do not provide adequate documentation on costs and fees, owner is rude on the telephone, much of the vertical services work appears to be his company as well. In fact, at one point Terry Kozell, the owner, refused to talk to me any further because I truly believe he thought I was too business savvy when I questioned some of his business practices. Read the contract very carefully and/​or have your attorney review it. It is very one-​sided and costly to terminate. Made the mistake of not checking BBB/​Yelp/​etc. prior to signing contract to manage a home in Gilbert, otherwise would have known to clearly stay away from Terry and his company. Have initiated complaints with Arizona Dept of Real Estate, BBB, etc. There are good property management companies in the area, and I would never use this company again.

Please please, do not rent from this company!
Action Properties and it’s employees are up scale slum lords. We rented a house for two years from Action, and it takes an act of god for them to fix anything that needs to be fixed if they do it at all. Why I moved in the house.. . The house was a great house in a very good location in Tempe, however the house was extremely dirty and the yard was in shambles. I figured I can clean a house and do some yard work no problem. But problems started to arise like none (and I do mean none!) of the blinds in the house was in working order. I was told it was not their responsibility, blinds are «cosmetic». The door bell was non-​existent it had fallen off the wall, they said it was «cosmetic» and they cannot fix it. All this is just the tip of the iceberg when it came to things they said they would not fix. When I moved out they pushed the entire blame on to me and they refuse to give back my deposit now. And yes I got blamed for the blinds and doorbell.
If you talk to somebody named Abby in the office, be prepared to have the nastiest and worst customer service ever. She will NOT work with you if there is a problem, and honestly she always has an attitude of I don’t care. If you try to call the office good luck getting someone to pick up, and even worse good luck getting somebody to call you back.
Please just don’t rent from these people!!!

Went to look at a rental house. Broker was 45 minutes late. Then, Abby, our new punctually challenged friend was extremely rude. Didn’t even say hello. Finally, she wasn’t able to give me a straight answer for a simple question. What a waste of time. If i could enter 0 stars I would.

Do not rent from them. The house we rented was in severe poor repair, filthy carpets, dirty every where, and looked like the bottom floor of the house had been flooded, when we moved in. And while living there the ac/​heat went out more than once. We improved that house by living there. Make sure you test all appliances also. We found out the microwave and dishwasher didnt work. And more than half the lighting and electrical in the house was broken, faulty or didnt work.
You will never get a hold of the Broker Terry — so dont even try.
Make sure you document every single thing with photos before you send in your move-​in inspection. We left off a torn piece of carpet that we didnt find until we vacuumed after move in, and they tried to charge us to fix it. Which means they charged the prior tenants for the repair, and now us.
Their lease states they are responsible for HOA items, but that is not entirely true.
