The other reviewer is absolutely correct. This attorney, Paul Fitzgerald, is disrespectful, discourteous, non-​communicative, and abusive.
When I would not hear from him for 3 or 4 months, and would send an email asking for an update, he would not respond. I would wait a few more weeks, then send another email begging for an update – nothing.
He refused to file the claim in the central court, although that was a legal option, but instead kept it in the little local court, where the other party (a local school district) had historically always received preferential treatment by the local court in all lawsuits. He, and his collegue, both confirmed that the school district always received preferential treatment, that the local courts were heavily biased toward the local school districts, and that they never lost a claim, no matter how wrong they were. Still, knowing all this — that the case would surely be lost in the small, local court, he insisted on keeping it in the local venue, rather than taking it to the large, central court, where it was also permitted to be heard. Had he taken it to the central court instead, we would have won against the school, as the little gang-​banger, Jeremy Roller, had a long record at the school for prior assault, and the school (Torrance High School) knew he was a danger but he was not expelled, because he was a star athlete, his father a school employee, and the school did not call the police according to their own policy when the punk broke my son’s face on the high school campus. The surgeon said she had never seen such a badly broken nose in her entire career, and that my son would need future surgeries to repair the damage, and that he would always have breathing problems.
Although I pointed out to Mr. Fitzgerald the legal code authorizing the parents of the minor to be held liable for the first $ 35,000.00 of the claim amount, he just called me crazy. This legal code is known as ‘Parental Liability’, but the parent of the minor has to also be named in the lawsuit for the code to apply. Mr. Fitzgerald refused to do this, although it would have secured at least some payment right away. Now, I have to wait until the little gang-​banger who broke my son’s face, (and was found guilty in a criminal court) decides to get a job, then I have to try to collect. Too bad Mr. Fitzgerald did not know about the ‘Parental Liability’ code, and called me crazy when I tried to show it to him.
At one point, I lost my cell phone, and informed him of this by email. He apparently did not even read my email, because he continued to telephone me on my cell phone, (not sure why he did not try my landline), then yelled at me (when he finally did call my landline) and became abusive towards me, accusing me of ignoring his calls, when I repeatedly tried to remind him that I had already informed him that I had lost my cell phone and had not been able to replace it.
This man is not legally competent, as he did not know about the ‘Parental Liability’ legal code regarding the case, and did not even bother looking it up to educate himself when it was pointed out to him. This man is abusive when you ask for an update, even though he does not communicate at all for months on end. This man showed only disregard and contempt for me, his client. My advice is steer clear of this abusive attorney.
