THE DEPARTMENT OF CONSUMER AFFAIRS ENTERS SETTLEMENT AGREEMENT FORCING UNSCRUPULOUS USED CAR DEALERSHIP TO PAY $ 441,000 IN FINES AND RESTITUTION
Planet Automotive Used Deceptive Advertising and High-​Pressure Sales Tactics to Coerce Consumers into Paying for High-​Cost Financing and Unwanted Add-​ons
Department of Consumer Affairs (DCA) Commissioner Julie Menin today announced a settlement agreement with Planet Automotive, Inc. and its owner. The agreement is a result of DCA’s charges that Planet Automotive used deceptive advertising to lure consumers in and then pressured those consumers into agreeing to thousands of dollars in unwanted add-​ons, such as extended warranties and theft protection, and then compelled those consumers to finance through the dealership. The agreement requires Planet Automotive, which now does business as Platinum Auto Mall at 37 – 15 Northern Boulevard in Long Island City, to pay $ 441,000 in fines and consumer restitution to 39 New Yorkers and to adhere to strict compliance with the law. The settlement agreement, which comes just months after DCA launched an aggressive investigation into the sale of unrepaired recalled used cars in New York City, also requires the dealership to check the recall status of each vehicle and repair all safety defects prior to sale. This is the first time DCA has made this requirement as part of a settlement agreement.
«With this comprehensive settlement agreement, DCA is continuing its efforts to protect consumers from unscrupulous used car dealerships,» said DCA Commissioner Julie Menin. «A car is one of the biggest purchases any family makes — especially low-​income and immigrant families — and we are vigilant about getting all New Yorkers restitution when they are deceived and taken advantage of by a business. This settlement agreement is a victory for DCA because it means a rogue business has agreed to come into compliance with the law and 39 families will be getting a refund after being cheated out of their hard-​earned money.»
In addition to refunding $ 284,000 and agreeing to not sell recalled cars, Planet Automotive will pay $ 157,000 in fines to the City and must also hire an independent monitor for at least one year. This monitor will work to reform Planet Automotive’s business practices, update its documents and forms, and report to DCA on the dealership’s compliance efforts. The dealership must comply with all laws, including clearly posting all prices, cancellations, and finance terms in all consumer contracts, and conspicuously post the Used Car Buyer’s Bill of Rights.
As required by the agreement, the dealership must provide any consumer who wants financing with a notice stating that consumers are not required to finance through the dealership, as well as other information about credit scores, obtaining a credit report, the finance charge for the purchase of add-​ons, including warranties and insurance, and the total finance charge and monthly installment cost to purchase the vehicle without add-​ons.

I call BS on these 5 star reviews naming mangers that don’t exist. I was there Friday 6÷28÷14 and went through a huge ordeal over them attempting to cheat us out of money AFTER they took our deposit and signed the papers. They then shredded the papers and cops were called (we called) it was ridiculous. Simply put if they say the price is 20,000 the price will be about 24, 579 by the time they add taxes, fees, commission etc. Smfh never EVER EVER again

Bought my 2008 audi A6 3 months ago, after a month, check engine lightscame on, threw FIVE CODES, took it to them but since they only wrk till 5 and i need my car for wrk i couldnt drop it off. Two week later on a rainy day i have water constantly dripping through my passenger door and water leaking into my headliner. I took it back and told them i didnt want the car i wanted my money back or traded out of it. They refused to wrk out a deal with me and kept on brushing me off and sending me to tlk to different Sales reps (like it made a difference) and completely ignoring me. Worst place ive ever dealt with. Also do not be fooled if the name of the Dealership is changed, i heard from nearby dealers that they are constantly changing their name. Now i know why! I would’ve traded the car in by now im afraid the next car is going to have issues as well, ill report these people to consumer affairs and eat up the down payment and trade the car in with another $ 4000 downpayment somewhere else.

BUYER BEWARE!!! My husband and I flew cross country Seattle to this dealership on NewYears Eve. We came to purchase my husbands dream car, and I spoke with the «sales mgr» Rony hours before our flight with him assuring me there would be no surprises. I did not listen to my gut feeling as he was very evasive on the phone, but because my husband wanted this car so bad I went ahead and bought the plane tickets. Biggest mistake ever! We were made to wait 4.5 hours only to find out they pulled the old «bait and switch» on us! The car we came for, and were sent pictures of, and test drove, suddenly became the car that was now $ 7000 more in price! Vin numbers were not matching up, and then we were told the car we saw the night before was another car that had been sold the night before. Which we believe there never was another car. we walked out and they coaxed us back in lowering the price, only to be told of the ridiculous $ 2995 fee that other people complained of! When we were dragged into the finance dept we still had no clear offer as the whole time they were very vague and shady! We only needed a loan for 2 weeks but they tried to make us get a loan for 6 months, and make it look like we never made a down payment! Whole experience was awful! From the salesman being late picking us up from the airport after flying all night, being kept waiting for over 4 hours and ignored, car being filthy, rudeness, dingy store, awful communication. My next letter will be to the Better Business Bureau! BUYER BEWARE!!!

I bought a 2012 vehicle from Platinum Auto Mall. The service was ok not to shabby. The vehicle I bought, was in excellent condition. I was able to negotiate on a price for the vehicle. The only issue I had was the dock fee I was charged. I WAS TOLD, the dock fee consists of them buying the vehicle from a specified location at then towing it to their dealership. The DOCK fee implemented just doesn’t sound right. It seemed everything I negotiated went down the drain with that unheard of fee. I went from buying a car for 18k to added fees that equates to 21k. The taxes and fees are extensive. I will add that the manager was upfront about the dock fee and overall the vehicle is driving great.

Bought a Vehicle from Platinum Automall (2013 Infiniti M) and the process was less than stellar. During the test drive I was told I could not take the vehicle on the highway because of «policy». Without being able to do that I could not tell that the rotors were warped and needed to be replaced when I bought the vehicle. Was also promised touch up paint to repair a few dings on the door jam that I never received. I bought the car 3 months ago and have been calling asking where it has been and never got a straight answer. Called back today to see if it was on its way and was informed by another «manager» Joshua that the sales associate I was dealing with no longer works with them and there is nothing they can do because it was all he said she said. «There is nothing in writing saying I was promised touch up paint so its not my problem» By far the worst customer service I have ever received. It boggles my mind that people like this still have a job! BUYERS BEWARE DO NOT BE FOOLED BY A GOOD PRICE YOU’LL PAY FOR IT IN THE LONG RUN!

The process took much longer than expected 1and longer than it had when I bought 2 cars previously at other dealerships.
A week after, my check engine light came on and my automatic car stalled TWICE– literally as I was driving In the city. This is not only frustrating, but unsafe!
I took it back, and it was «fixed.» Check engine light came on again and it was fixed again. The Inspection sticker was replaced then (I’m not sure why but that’s not an issue).
A few weeks later, I realized on my own that my temporary registration had EXPIRED. They didn’t mail me a new one, In fact they had not even sent the paperwork to the DMV. They gave me a new temporary registration that expires February 30– THERE IS NEVER at 30^th of February. They did not even begin the process for this until February — I know this because this is when my insurance company notified me.
The guy who does the financing was also professional and helpful. But there is a typo on my finance contract– A TYPO. instead of subtracting my down payment it was added so it looks like I will ultimately pay 5k more than I actually will on the car
UNBELIEVABLE. I’m not even mad this is so ridiculous. I will be happy to NEVER go back… After I pick up my registration from them. Again.

and when you show up to «make your» deal they hit you with a $ 2995 «certification» fee. For obvious reasons they want you to Finance your car versus paying cash. Everything from the creaky doors to the show room that hasn’t seen $ 50 thrown at it in the past 10 years will make your skin crawl. Run away from this place like the plague because you’ll invariably get a better deal somewhere else, with better service and no hidden fees. Avoid at all costs.
