Michael Duffy

As per the usual the patient is poorly informed on either side of the factually correct information. The cause and effect of Dr. Michael Duffy’s unethical, illegal conduct is public information on the California Medical Board’s public website. Dr. Duffy’s license to practice medicine has been stricken. However. under terms of a settlement agreement he received a stay to remain on probation for five years.
The following (per public record) is the Business and Ethics code he was found guilty of by a tribunal of his peer’s.
2305. (1) The parties if they so intend can conclude a contract for sale even though the price is not settled. In such a case the price is a reasonable price at the time for delivery if (a) Nothing is said as to price; or (b) The price is left to be agreed by the parties and they fail to agree; or © The price is to be fixed in terms of some agreed market or other standard as set or recorded by a third person or agency and it is not so set or recorded. (2) A price to be fixed by the seller or by the buyer means a price for him to fix in good faith. (3) When a price left to be fixed otherwise than by agreement of the parties fails to be fixed through fault of one party the other may at his option treat the contract as canceled or himself fix a reasonable price. (4) Where, however, the parties intend not to be bound unless the price be fixed or agreed and it is not fixed or agreed there is no contract. In such a case the buyer must return any goods already received or if unable so to do must pay their reasonable value at the time of delivery and the seller must return any portion of the price paid on account.
As to his «surrendering» his license. Don’t be naïve. Please take this simple example for your understanding: it would be as though your employer is going to fire you regardless as you are guilty of the offense. However, in order for you to save face he/​she graciously allow’s you to resign vs. termination. You then move to another State as you are now unemployable and apply for another job and they allow you a second chance. Hope that was simplistic enough.

I am a PA looking for a job… and Dr. Duffy is by far the best interviewer and human being. Referring to Carol S. reviewer… we all are human beings, trying and failing to be like God. I try everyday to be «perfect»…and failing every time. :)

Check your facts… he didn’t «lose his license» in another state. He surrendered it. Very different. And he is only on probation here because of what happened there…
