Law Offices of Christopher A. Benson

This was more than a decade ago, but I was talking about it yesterday so it brought it to my mind again… we were sued by a real estate broker because of what our agent did. We talked to our agent asking him to straighten it out which he said he did (twice). When he still was after us we asked the agent what we should do. Our agent sent us to Mr. Benson who was his attorney. Our lawsuit went to arbitration and we lost. Mr. Benson asked what we wanted to do and we said our agent should pay, he got the commission. Well, since the agent was also his client he THEN said he had a conflict of interest and could no longer represent us. We had already paid him a bunch of money. I believe it was in excess of $ 10,000 but not positive. Although it turned out to be a good thing because we won the case on summary judgement (which was upheld when the jerk broker appealed that) when we got a good (okay GREAT) lawyer. The new lawyer asked us a couple of times if we had signed something agreeing to have him represent us with the conflict of interest. So he protected his original client (the one who GOT THE COMMISSION) and we paid the legal fees for that. When we finally won and were awarded our legal fees they were limited so we were still out most of what we paid Mr. Benson. The only thing on his behalf was at the very beginning all were hoping that if he sent a letter it would go away, but that didn’t happen. He definitely should not have represented us at arbitration. Really it should have been the agent who was sued to begin with, but he wasn’t so that’s 3 years of my life I am never getting back.
